Mastt Referral Program Terms

1. About these terms

1.1 These terms govern your participation in the Mastt Referral Program (Program), operated by Mastt Australia Pty Ltd (ABN 78 624 216 075) (Mastt, we, us).

1.2 By registering for the Program, you agree to these terms. If you register on behalf of a company, you confirm you have authority to bind it.

1.3 In these terms:

• Referrer (you) means the person or company registered in the Program.
• Referral means a company you introduce to Mastt through your referral link or another method we accept.
• Program Page means the Referral Program page in the Mastt web app, and any other page we nominate, setting out the current Reward and Reward conditions.
• Reward means the payment described on the Program Page.
• Referral Portal means the third-party referral platform we use to run the Program, currently Dub (dub.co), or any replacement platform we notify you of.

2. Who can participate

2.1 Anyone aged 18 or over may join the Program, whether or not they are a Mastt customer.

2.2 You may not participate if you are:

• a Mastt employee, contractor or director, or a member of their immediate household; or
• prohibited by your employer, client or any law or policy from receiving a Reward for the introduction.

2.3 You are responsible for making sure that accepting a Reward does not breach any obligation you owe to your employer, your clients or the Referral. If you are a consultant or adviser to the Referral, you must disclose the Reward to them where required.

2.4 We may decline or cancel any registration at our discretion.

3. Eligible referrals

3.1 A Referral is eligible only if, at the time you refer them, the Referral:

• is not an existing or former Mastt customer;
• has not already started a commercial engagement with Mastt, including an active sales conversation, trial, proposal, pilot or procurement process; and
• has not already been referred by someone else.

3.2 The Referral must become a paying Mastt customer within 6 months of the date you refer them.

3.3 You may not refer yourself, your own company, or a company you control.

3.4 If two or more Referrers introduce the same company, the first referral recorded in the Referral Portal takes priority.

3.5 We decide whether a Referral is eligible, acting reasonably. Our records, and those in the Referral Portal, are final in the absence of manifest error.

4. Rewards

4.1 The Reward amount, the conditions for earning it, and payment timing are set out on the Program Page. They are subject to change.

4.2 A change to the Program Page applies to Referrals made after the change. A Referral made before the change keeps the Reward and conditions shown when you made it.

4.3 Unless the Program Page says otherwise:

• Rewards are stated in Australian dollars and are inclusive of any GST;
• a Reward is paid within one month of the Referral becoming a Mastt customer, which happens when its first payment to Mastt has cleared; and
• one Reward is payable per Referral, however many people or entities within that company sign up.

4.4 Rewards are paid through the Referral Portal to the payout account you set up there. You must provide accurate payout and tax details, and any information the Referral Portal provider needs to verify your identity.

4.5 You are responsible for any tax payable on Rewards you receive.

4.6 If a Reward is paid in error, or the Referral's first payment is refunded, reversed or charged back, we may deduct the amount from any future Rewards payable to you. We will not otherwise seek repayment.

4.7 Rewards cannot be transferred or exchanged for Mastt credits unless we agree.

5. Your conduct

5.1 You must promote Mastt honestly. You must not:

• make false or misleading claims about Mastt, its products or pricing;
• present yourself as a Mastt employee, agent or partner;
• send spam or unsolicited bulk messages, or breach anti-spam or privacy laws;
• bid on Mastt brand terms in paid search, or use Mastt trademarks except as we permit; or
• create fake accounts, self-referrals or any arrangement designed to earn a Reward unfairly.

5.2 If we reasonably believe you have breached these terms, we may withhold or recover Rewards and remove you from the Program.

6. Your data

6.1 We collect the information you and your Referrals provide through the Program, such as names, contact details, company details and payout details.

6.2 We use it only to run the Program, including tracking Referrals and paying Rewards.

6.3 We will not share it outside Mastt and the Referral Portal provider, except where required by law. The Referral Portal provider handles your information to track and manage the Referrals you submit and to pay your Rewards. It does so under its own privacy policy.

6.4 Before you share someone's contact details with us, you must have a reasonable basis to believe they are happy to be contacted by Mastt.

6.5 Our Privacy Policy also applies.

7. Changes and ending the Program

7.1 We may change these terms, or suspend or end the Program, at any time by updating this page or the Program Page.

7.2 If we end the Program, we will still pay Rewards for eligible Referrals made before the end date that meet the conditions within the 6-month window.

7.3 You may leave the Program at any time by contacting referrals@mastt.com.

8. General

8.1 You participate as an independent party. Nothing in these terms creates an employment, agency, partnership or joint venture relationship.

8.2 To the extent permitted by law, our total liability to you in connection with the Program is limited to the Rewards payable to you under these terms. Nothing in these terms excludes rights you have under the Australian Consumer Law that cannot be excluded.

8.3 These terms are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales.
